Terms of Service for Gingerale Apps

By downloading, accessing, or using any mobile application ("App") developed by Gingerale Apps ("we," "us," or "our"), you agree to comply with these Terms of Service and our Privacy Policy. If you do not agree, do not use our Apps.

1. Acceptance of Terms

Your use of our Apps constitutes acceptance of these Terms of Service and our Privacy Policy, accessible at https://gingeraleapps.com/privacy. The Terms are subject to updates, and your continued use of the Apps after any such updates implies your acceptance of those changes.

2. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction) to use our Apps. If you are under the applicable age limit in your jurisdiction, you may only use our Apps with the consent of a parent or guardian.

We do not target or knowingly collect data from children under 16. If we become aware that we have inadvertently collected personal data from children under 16, we will take steps to delete such data.

3. License to Use

We grant you a limited, non-exclusive, revocable license to use our Apps solely for personal, non-commercial purposes, excluding any use for business, commercial, or revenue-generating activities unless explicitly permitted by us.

You may not reverse-engineer, decompile, or modify our Apps without prior written consent from Gingerale Apps.

4. User Responsibilities

You agree not to:

Reverse-engineer, decompile, or modify our Apps;
Use our Apps for any illegal activities, including privacy violations, copyright infringement, or unauthorized access;
Disrupt the app's functionality, circumvent security measures, or interfere with the service in any way;
Engage in scraping, redistributing, or exploiting any part of the App's content without authorization.

5. In-App Purchases & Subscriptions

Payment Processing: All payments for in-app purchases, including subscriptions, are processed by the Apple App Store or Google Play Store. We do not store or have access to your payment information.
Subscriptions: Subscriptions provide access to premium app features and are managed through RevenueCat. Subscriptions automatically renew at the end of each billing cycle unless canceled at least 24 hours before the renewal date.
Free Trials: If you opt for a free trial, the applicable trial period is clearly stated during the subscription process in the App Store or Google Play Store. After the trial expires, your subscription will automatically convert to a paid subscription unless canceled before the trial ends.
Managing Subscriptions and Cancellation: You can manage or cancel your subscriptions at any time through your Apple App Store or Google Play Store account settings. Please note that cancellation must be done via these platforms; we cannot cancel subscriptions on your behalf.
Refunds: Refund requests must be made directly through Apple or Google according to their respective refund policies.

6. Intellectual Property

All content within the App (including code, graphics, trademarks, and logos) is owned by Gingerale Apps and is protected by copyright and other intellectual property laws. Unauthorized use, reproduction, modification, distribution, or exploitation of any content is strictly prohibited.

7. Disclaimers

No Warranty: The Apps are provided "as-is" without any warranty of any kind, either express or implied, including but not limited to warranties of fitness for a particular purpose, accuracy, and reliability. We do not guarantee that the Apps will be error-free, secure, or continuously available.

Third-Party Services: Our Apps use third-party services such as Sentry.io, PostHog, and RevenueCat. Your use of these services is governed by their respective terms of service, which you should review.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any damages arising out of the use, misuse, or inability to use the Apps, including but not limited to:

Damages arising from app downtime or service interruptions;
Third-party actions, including but not limited to app store policies, payment errors, or issues with third-party services.

This limitation of liability does not affect your statutory rights as a consumer under applicable local law.

9. Termination

We reserve the right to suspend or terminate your access to our Apps at our sole discretion for violations of these Terms of Service. You may terminate this agreement at any time by uninstalling the App.

10. Governing Law

These Terms of Service are governed by the laws of Baden-Württemberg, Germany. Any disputes arising under these Terms will be resolved in the courts of Baden-Württemberg, Germany, unless mandatory law requires otherwise.

Nothing in these Terms affects your statutory rights under applicable local consumer protection laws.

11. Updates to Terms

We may update these Terms periodically. Users will be notified of major changes via a prominent notice within the App or our website. Continued use after any such changes implies acceptance of the updated Terms.

We will notify you of significant changes to subscription terms or billing practices via the app store or our website. Your continued use of paid features after such changes constitutes acceptance.
